Terms of service
The purpose of this contract is the provision of videography services for events (specifically weddings and celebrations) by Eric Benajes / Eric Benajes Filmmaker to the client. The service includes recording, editing, and delivery of material according to the contracted package.
The event date will only be considered reserved after payment of 50% as deposit or reservation fee.
The remaining balance must be paid according to the agreed-upon schedule (e.g., 50% at the signing of the contract, 30% a month before the wedding and the 20% remainder just before final delivery).
In the event of cancellation by the client, the deposit is non-refundable due to the date being held and the potential loss of other bookings.
Authorship: Eric Benajes/Eric Benajes Filmmaker retains intelectual property and copyright rights to all recorded images.
Personal Use: The client is granted a license to use the material for personal and private purposes. The sale or commercial use of the material by the client is prohibited without prior consent.
Portfolio Rights: The client authorizes the videographer to use excerpts from the video and the entire videos and highlights to promote their work on social media, websites, and in competitions.
Equipment: In the event of an accidental equipment failure, the videographer undertakes to minimize damage by using backup equipment, but will not be liable for loss of material beyond their reasonable control.
Force Majeure: If, due to accident, illness, or force majeure, the videographer is unable to attend, the undertake to find a reliable substitute of similar skill or to fully refund all payments made if he cannot find someone to film the event.
Professional Judgement: The client hires the videographer for his/their artistic style. The final editing (shot selection, music, color correction) is at the videographer’s professional discretion.
Revisions: One round or minor revisions is included (e.g., one revision for minor changes such as name corrections or specific shots requested). Significant structural changes after final delivery may incur an additional cost.
The estimated delivery time for the final video/s vill be 4-6 months after the event date. The material will be delivered digitally.
